How to Select an Arbitrator (Arbitration.com)

SUGGESTED WAYS TO SELECT AN ARBITRATOR

Parties to a dispute may save ADR forum filing fees and administrative fees by using one of the following methods of selecting an arbitrator.

However, if you feel that the structure provided by an ADR forum would be helpful to resolving your dispute, then be sure to included an "associations" selection in your arbitrator search.

1) Use You Draw Straws to help make your arbitrator selection

2) Have a respected third party select your arbitrator for you.

3) Have your attorney and the other party's attorney select the arbitrator (This is usually possible).

4) Have each side to the dispute select a certain number of choices for arbitrator (say 5, 7, or 9), then let each side strike through a certain number of the other side's choices (say 3, 5, or 7). Then place the remaining names in a hat, and have someone draw one out. That name is your arbitrator! (It is recommended that you have an alternative selected also in case the first choice has scheduling or other conflicts and cannot serve).

5) Have each side to the dispute select a person (from Mediator.com or Arbitration E-Directories of alternative dispute professionals). Then let these professionals choose your arbitrator.
